One of the two shots fired in the incident was recovered: a .40-caliber round, the kind issued to police. Marinero was struck in the head with a round from a .22-caliber handgun. A .22-caliber handgun was found in the area where Marinero was when shots were fired.

So did the police officer shoot Marinero with a handgun that was in the apartment?  A .22 cal handgun? I can't imagine that the police officer was carrying such a small cal handgun.  Did Marinero kill himself with the .22 cal handgun?  Did the .40 cal round miss?  I think so.  Is this why the police officer was not charged?  Why wouldn't the paper say that the bad guy shot himself?  It's a very muddy article as far as facts that make sense.  (in my opinion)</description>
