On 07/13/2009 at 12:58 p.m., an alleged rape was reported in the 800 block of West Side Drive. The suspect is known to the victim.

Burglary

On 07/10/2009 at 5:25 a.m., police responded to 213 North Frederick Avenue, GAB Investment, LLC. for an alarm. An unknown suspect forced their way into the unoccupied business and fled prior to police arrival. No property was taken.

Aggravated Assault

On 07/08/09 at 11:30 p.m., a aggravated assault occurred at the unit block of Water Street, between two known individuals. It was revealed that the individuals were involved in a verbal altercation that eventually escalated into a physical altercation. Police responded, conducted an investigation and later arrested one of the individuals, without incident.

Aggravated Assault

On 07/06/2009 at 1:14 p.m., an aggravated assault was reported at the Rio Mall located at 9811 Washintonian Boulevard. The assault followed after a traffic dispute between both parties. Both parties are known to each other.


Saturday, July 04, 2009

Armed Robbery

On 07/03/2009 at 9:45 p.m., an armed robbery was reported at the Goodwill Store located at 619 South Frederick Avenue. The suspect approached the employee, removed cash and fled the business. The employee was not harmed. Investigation is on going.

Suspect- a black male, 6′01″, 160-180 lbs, wearing a ski mask, black shirt and khaki pants.

Armed Robbery

On 07/03/2009 at 3:50 a.m.,an armed robbery was reported in the area of Travis Avenue and Watkins Mill Road. An unknown black male struck the victim with a possible silver handgun and stole property. Suspect fled on foot.

Suspect: Black male, early 20’s, 6′01″ 150 lbs., black short sleeve shirt and blue jeans.

Attempted Armed Robbery

On 07/01/2009 at 2:10 a.m., police responded for the report an attempted armed robbery of a taxi driver. The driver picked up three (3) suspects from Germantown and drove them to the 500 block of Palm Tree Drive. Once all three (3) were out of the vehicle, one approached on the driver’s side, displayed a knife and asked for his money. The driver drove away and called the police. There were no injuries and nothing was taken.

Suspect #1 - Black male, heavy set, wearing a white t-shirt and jeans.
Suspect #2 - Black male, thin build, 5′11″, had his hair in braids, wearing a grey tank top and black shorts.
Suspect #3 - Black male, medium bushy hair, wearing a black shirt and pants.

Burglary

On 6/29/09 a burglary was reported in the unit block of School Drive. The burglary occurred between 6/26/09 at 10:00 P.M. and 6/27/09 at 12:00 P.M. Entry was made through an unlocked door or a key was possibley used. Property was removed and there are no suspects.

On 06/25/2009 at 5:31 p.m., a burglary was reported in the 300 block of Market Street West. Unknown suspect(s) entered the residence without force and removed property. The residence was unoccupied during the incident. Investigation is ongoing.

Sex Assault

On 06/25/2009 at 7:37 p.m., a sexual assault was reported at the Gaithersburg Water Park located at 512 South Frederick Avenue. The suspects are known to the victims. Investigation ongoing.

Burglary

On 06/23/2009 at 1:58 a.m., officers responded to an alarm at The Mac Store, located at 895 Quince Orchard Road. Upon arrival officers found the rear door had been kicked in. Investigation revealed that an unknown suspect(s) forcibly entered the establishment through the rear door and removed property. The property was unoccupied during the incident. Investigation continues.

On 06/21/2009 at 11:01 p.m., a burglary was reported in the 700 block of Quince Orchard Boulevard with unknown suspect(s). There were no signs of forced entry. Items were removed. Investigation is ongoing.

On 06/19/09 at 11:59 p.m., a burglary was reported at the 200 unit block of Lee Street. The victims advised that sometime between the hours of 6:00 p.m. and 9:30 p.m., an unknown suspect(s) entered the residence through the front door and removed property. The residence was unoccupied during the incident. Investigation continues.

Agenda - Mayor and City Council Meeting, 7/6/2009

What I think is the most interesting part of this week’s Council agenda is a public hearing on changes to the City’s animal control ordinance. There are several significant new rules in the proposed changes, and if you own pets or otherwise have interactions with animals in the City, I would highly recommend that you read through the background document carefully. Monday’s public hearing will be one of your principal opportunities to comment on this issue; as always, you can also provide input to City Hall via electronic or postal mail. Below, I’ve highlighted some of the most significant new language.

Should this proposal be approved, residents within the City:

  • Will not be allowed to tether an animal (e.g. keep their dog on a chain) for more than a brief period of time. The law previously placed restrictions on the type and length of tethers, and required animals to be allowed exercise breaks after being chained up for more than 10 hours; the new law would simply outlaw them.
  • Will be subject to additional and clarified restrictions regarding animal waste and overcrowding.
  • Will be subject to new restrictions on placing food out for wild animals.
  • Will be required to obtain a permit from the City to allow their animals to breed. Anyone who has allowed their animal to become pregnant will be required to obtain a permit within 10 days of the birth of the litter. There are additional restrictions on the age of the animals to be bred and the frequency with which they may be bred.
  • Will be subject to additional new restrictions, detailed in the background materials.

Some excerpts from the new language:

(5) No person shall tether, fasten, chain, tie, or restrain an unattended dog, or cause such dog to be tethered, fastened, chained, tied, or restrained, to a dog house, tree, fence, or any other stationary object. Nothing in this paragraph shall be construed to prohibit a person from reasonably restraining a dog for short periods, considering weather and relevant conditions, or while using accommodations that are associated with a licensed activity, or from walking a dog with a hand held leash.

(b) Sanitation:

(1) No person owning, harboring, keeping or in charge of any dog, cat or other animal shall cause, suffer or allow such dog, cat or other animal to soil, defile or defecate on any public property or upon any common thoroughfare, sidewalk, passageway, bikepath, play area, or common grounds owned jointly by the members of a homeowners or condominium association, or any place where people congregate or walk or upon any private property other than that of the owner or custodian, unless such person immediately removes and disposes of all feces deposited by such animal by the following methods:

(i) Collection of the feces by appropriate implement and placement in a paper or plastic bag or other container; and

(ii) Removal of such bag or container to the property of the animal owner or custodian and disposal thereafter in a manner as otherwise may be permitted by law.

(2) No person owning, harboring or keeping or in charge of any dog, cat or other animal shall permit any waste matter from the animal to collect and remain on the owner’s or custodian’s property, or the property of others so as to cause or create an unhealthy, unsanitary, dangerous or offensive living condition on the owner’s or custodian’s property, or to abutting property of others.

(3) No person owning, harboring, keeping or in charge of any dog, cat or other animal shall cause unsanitary dangerous or offensive conditions by virtue of the size or number of animals maintained at a single location or due to the inadequacy of the facilities.

Sec. 4-6. Attracting wild animals; rabies vector animals.

(a) It is unlawful for a person to use an attractant or otherwise to engage in any activity or behavior that is intended to attract, to encourage the tameness of or to otherwise encourage any wild animal or any designated rabies vector species to be unafraid of human activity.

(b) Attractants may be placed solely for the purpose of feeding wild birds and small mammals if placed in feeding devices or structures at a sufficient height or design to prevent access by deer or rabies vector animals.

(c) Feed that is deposited by natural vegetation or found solely as a result of normal agricultural or gardening practices is not a prohibited attractant.

(d) The city manager or designee may from time to time require the temporary removal of such structures and devices during a high incidence of rabies or otherwise to protect the health, safety and welfare of residents.

Sec. 4-8.1. Breeders and Litter Permits.

(a) Every person who resides within the city who intentionally or accidentally permits the breeding of single dog or cat or makes a single dog or cat available for breeding shall obtain a breeders permit. Such permit shall be obtained from a person designated by the city manager to issue such permit. Permit fees shall be set by resolution of the city council.

(1) Each permit authorizes the whelping of no more than one litter per female dog or cat in any 12-month period.

(2) Female dogs and cats may only be bred when they are at least 2 years of age and are no older than 6 years in age, and each mother dog or cat must be micro-chipped and maintain adequate body weigh before and after whelping.

(b) Every person who fails to obtain a breeders permit who is in possession of a litter of puppies or kittens shall obtain a litter permit within 10 days of the birth of said animals. Such permit shall be obtained from a person designated by the city manager to issue council.

(c) Failure to obtain a permit under this Section shall constitute a municipal infraction with a fine in an amount set by resolution of the city council and may result in the seizure and impoundment of the female dog or cat and litter.
