Gaithersburg, as an incorporated city, is subject to Article 66B—Land Use, of the Annotated Code of Maryland. Section 3.05, of Article 66B, requires that the City’s Master Plan shall be reviewed and if necessary revised or amended at least once every six years. The adoption of the 2003 Land Use plan was a revision and amendment to the City’s 1997 Master Plan meeting the Article 66B requirement. The Land Use plan contains ten (10) special study areas, of which seven (7) have been adopted. The purpose of this amendment is to incorporate the Kentlands Commercial District Special Study Area into the adopted 2003 Land Use plan, and element of the City’s Master Plan.

The land use proposals described in the Kentlands Commercial District Special Study Area plan have been formulated using a series of community charrettes, a citizen survey, a private urban design consultant, and staff’s professional judgment and knowledge of the City. Further information regarding the 2003 Land Use Plan and the Kentlands Commercial District Special Study Area is available for public inspection from the Department of Planning and Code Administration at City Hall, 31 South Summit Avenue, between the hours of 8 a.m. and 5 p.m., Monday through Friday.

County Council to hear briefing on GE Tech Park Proposal; use may not be allowed under current zoning

According to the County Council agenda for next Tuesday, January 22:

10:45 BRIEFING - County Property Use Initiative, a proposal to relocate services from Public Safety Training Academy (PSTA) and County Service Park to GE/Edison Tech Park in Gaithersburg

Gaithersblog readers may recall my earlier posts on this topic. Additionally, a Gaithersblog reader has pointed out to me that one of the primary uses the County has in mind for this property — County Liquor and School Cafeteria distribution warehouses — may in fact not be allowed under the current zoning (I-3) for this property. According to the City Code, Part II, Chapter 24, Article III, Division 15, I-3 Zone, Section 24-143 (emphasis mine):

(2) Public buildings and uses subject to the following requirements:
(a) The minimum lot or parcel area shall be at least twenty (20) acres in size.
(b) No on-site parking or storage of trucks, either within a building or on the exterior, or motor vehicles other than automobiles for employees and customers of the facility are allowed.
(c) All parking areas shall be set back at least fifty (50) feet from any common property line or public right-of-way and shall be screened by fencing or planting at least four (4) feet in height.
(d) No distribution uses are allowed. For the purpose of this section “distribution uses” is defined as the primary use of the property for the collection and transfer or dispensing of personal property or equipment to public or private recipients.

Note this restriction on distribution uses only applies to public buildings and uses, and therefore the current Peapod grocery distribution warehouse is not excluded under this rule.

The County is currently asserting that they are not subject to City zoning — Ike Leggett said so in response to a question in his call-in show last month, and County Assistant Chief Administrative Officer Diane Schwartz Jones said as much in her presentation at the January 7 City Council Meeting. But for them to come in and blatantly violate not just the spirit but the letter of the City’s ordinances right from the get-go, is pretty offensive in my opinion.

In my mind, this raises the question of whether there will be any sort of controls whatsoever on that property once it is taken over by the County. If the County believes that the City’s zoning doesn’t apply, and the County doesn’t have any zoning for that property because it is outside the jurisdiction of M-NCPPC, would this not mean that the County can do just whatever it likes there? All the assurances that the County might be making about the compatibility of their activities on that property have to be taken with an enormous grain of salt.

Folks, I think that the City of Gaithersburg is about to get 100 acres smaller.

Another North Gaithersburg Development

I just noticed in the current legal notices on the City’s website the announcement of a public hearing on an application for a sketch plan amendment on the property owned by the Humane Society of the United States up at the end of Professional Drive. The application calls for six-to-twelve story office and residential buildings on ten acres of land: This property is nestled right in the corner of the proposed Casey East development, labeled property 5 in this photo from the Casey East project (Casey East is property 7 in the photo).

At this time there are no background materials that I can find on the City’s website.

08/20/07 Mayor and Council Meeting

The agenda below is from the City’s website. There’s a few potentially interesting items on the agenda. First is a public hearing on changes to the voter registration procedures in the City. What this is about is removing the City’s own voter registration list, which for some time was maintained separately from the master voter registration list used for county, state and federal elections. It has been so long since anyone has registered this way that there now is no one on that list, and they’d like to remove the charter provision that provided for it. This is likely not to change anything in fact. What is more interesting is the fact that this was noted in the process of determining whether there was any procedure in place to exclude non-citizens from registering to vote; as I’ve mentioned previously, the answer appears to be that only the threat of prosecution for perjury stands in the way of an illegal immigrant’s registration.

The second thing I’d call attention to is the latest update on the $25 million swimming pool the City plans to build in the Lakelands. I’ve extracted a few images from the background materials:
